Terms & End User License Agreement

These terms are written in plain language on purpose. They are still a contract. The license agreement for the Phospho app is between you and:

1. Who sells you the license
Phospho is distributed through the Mac App Store, so Apple is the seller of record. Apple handles payment, applicable taxes such as VAT, receipts and refunds. Your purchase and download are also governed by Apple’s Media Services Terms.
This agreement covers your right to use the Phospho software. It is between you and us. It is not an agreement with Apple, and Apple is not responsible for the app or its content.
2. What Phospho is
Phospho is a macOS menubar app that streams your screen’s colours to Philips Hue Entertainment lights in real time, over your local network. It requires a Mac running a supported version of macOS, a Philips Hue bridge, and Hue Entertainment-capable lights with a configured entertainment area.
Phospho is an independent app that works with Philips Hue lighting. It is not affiliated with, endorsed by, or sponsored by Signify or Philips. Philips Hue is a trademark of Signify Holding B.V.
3. Free trial
Phospho includes a 14-day, full-featured free trial. You start it from inside the app, and because Phospho is distributed through the Mac App Store, starting it is a free App Store purchase: you will be signed in with your Apple ID, nothing is charged, and no payment card is required. You create no account with us, and we never see your Apple ID or your payment details. When the trial ends, streaming stops until you unlock Phospho with the one-time in-app purchase. Everything else about these terms applies during the trial too.
4. Your license
When you unlock Phospho, a one-time in-app purchase at the price the App Store shows for your country, we grant you a perpetual, personal, non-exclusive license to use the app. The unlock is a non-consumable purchase tied to your Apple ID.
What that means:
- It is a one-time purchase, not a subscription, and it does not expire.
- It follows your Apple ID rather than a particular machine. Install and unlock Phospho on every Mac signed in to the same Apple ID. If the unlock does not appear, choose Restore Purchases in the app.
- The license is personal to you. It is not a site license, and it may not be resold, rented, sublicensed or transferred, except where the App Store’s own rules allow it, such as Family Sharing.
- You create no account with us. Phospho confirms the unlock through the App Store. We run no activation server and hold no account for you.
5. Updates and versions
Your unlock covers all 1.x releases at no extra charge, meaning bug fixes and feature updates within the version 1 series. A future major version, such as 2.0, may be sold separately. The version you bought keeps working either way.
Updates are delivered through the Mac App Store.
6. Your purchase lives in the App Store
The unlock is an App Store purchase tied to your Apple ID, so there is no license key to keep track of and nothing you can lose. It restores on any Mac signed in to the same Apple ID; if it does not appear, choose Restore Purchases in the app. We run no account system and store no key, so there is nothing on our side that could lock you out of something you have paid for.
If your purchase doesn’t show up after restoring, write through the contact form and we will help; for billing and refunds, Apple is the seller (see section 11).
7. What you may not do
- Sell, rent, redistribute, or sublicense the app, or share it outside what the App Store’s own rules allow.
- Circumvent, remove, or tamper with the unlock check or the trial.
- Reverse-engineer, decompile, or disassemble the app, except to the extent applicable law expressly permits it despite this clause.
- Use Phospho in violation of applicable law, or of the terms of the third-party products it works with.
8. Health and safety: photosensitivity
Some light patterns, particularly fast colour changes and intense flashing, can cause discomfort and, rarely, seizures in people with photosensitivity. If you feel unwell while using Phospho, stop immediately. The app shows this warning before first use and requires your consent. Please take it seriously.
9. Known limitations
We would rather document Phospho’s limits than hide them.
- DRM-protected content returns black frames to screen capture, so the lights go dark. This affects Netflix, Disney+ and other services that honour HDCP in their apps or in the browser. It is a system-level restriction we cannot work around inside the app.
- Phospho depends on your Hue bridge, your lights, your network and macOS APIs we do not control. The behaviour of those components can change without our involvement.
10. Warranty and liability
We build Phospho carefully and test it seriously, but it is provided as is, to the extent applicable law permits. To that same extent we exclude liability for indirect or consequential damages, and our total liability is limited to the amount you paid for your license.
Nothing in this section excludes or limits liability that cannot be excluded under applicable law, including liability for intent or gross negligence under Swiss law. Nothing in these terms reduces the mandatory rights you have as a consumer under the law of your country of residence.
11. Refunds
See the separate Refund Policy. In short: Apple, as seller of record, processes App Store refunds; EU consumers’ statutory rights are respected; and the 14-day trial exists so you never have to buy blind. If a purchase is refunded, the license granted in section 4 ends.
12. Termination
Your license ends automatically if you materially breach these terms (for example, by circumventing the unlock check or redistributing the app) and, if the breach can be remedied, you fail to remedy it within a reasonable time after we notify you. Sections 8–10 and 13 survive termination.
13. Governing law
These terms are governed by Swiss law, without prejudice to any mandatory consumer-protection rules and mandatory forum rights of your country of residence.
14. Changes to these terms
We may update these terms for future versions and future purchases. Changes do not retroactively shrink a license you already bought. The current version always lives at phospho.ch, with the date at the top.
15. App Store terms Apple requires
Phospho is sold through the Mac App Store under this license rather than Apple’s standard one, and Apple requires a custom license to state the following. Each point is here because Apple’s rules require it.
- This agreement is with us, not Apple. We alone are responsible for Phospho and its content.
- Where you may run it. Your license covers use on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms.
- Support is ours. We are solely responsible for maintenance and support. Apple has no obligation to provide either.
- Warranty. Any warranty is ours. If Phospho fails to meet an applicable warranty, you may notify Apple, and Apple will refund what you paid for it. To the maximum extent the law allows, Apple has no other warranty obligation.
- Claims about the app. We, not Apple, are responsible for any claim relating to Phospho or your use of it, including product liability, any failure to meet a legal or regulatory requirement, and claims under consumer-protection or privacy law.
- Intellectual property. If a third party claims Phospho infringes their intellectual property, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
- Sanctions and export. By using Phospho you confirm that you are not located in a country subject to a U.S. Government embargo or designated by it as terrorist-supporting, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple may enforce these terms. Apple and its subsidiaries are third-party beneficiaries of this agreement, and Apple has the right to enforce it against you.
16. Language
If these terms are translated into another language, the translation is provided for convenience only; the English version is the authoritative text and governs in the event of any discrepancy.
